Terms of Sale

These general terms of sale (the "Terms of Sale") govern the purchase of paid subscriptions to the Pronext service (the "Service") offered by PATOUAH PARNASSE LTD, a Private Limited Company registered under number 14189040 (Companies House, England & Wales), whose registered office is at 5 Brayford Square, London E1 0SG, Royaume-Uni ("Pronext", "we"), to any consumer acting for non-professional purposes ("you"). You can reach us by email at contact@pronext-app.com. They supplement the Terms of Use, which continue to apply to the use of the Service. Any subscription constitutes acceptance of the Terms of Sale in force on the date of the order.

1. The plans

The Service is available under three plans:

Freemium — free: access to the application and to match fixtures, with limited features.
Standard — €14.99 per month: full match sheet, unlimited predictions, Expert mode and detailed AI explanations.
Pro — €29.99 per month: everything in Standard, plus the Pix AI assistant, news and probable line-ups, premium notifications, widgets and priority support.

The details of the features included in each plan are set out on the Pricing page. Prices are expressed in euros, all taxes included. The content of the plans may change; a change that would substantially reduce the features of an ongoing subscription entitles you to cancel it.

2. Subscribing

Subscribing requires a Pronext account and is restricted to adults. It is done:

On the web (https://app.pronext.io): payment by bank card via Stripe Checkout, a payment page hosted and secured by Stripe; Pronext never has access to your card details.
On iOS and Android: in-app purchase through your App Store (Apple) or Google Play (Google) account, at the same price.

The contract is concluded upon confirmation of payment; you then receive a confirmation by email (web) or from your app store (mobile), and the plan is activated immediately on your account. We may refuse or cancel an order in the event of fraud, a previous payment dispute or use contrary to the Terms of Use.

3. Price and payment

The applicable price is the one displayed at the time of subscription. It is charged every month, on the anniversary date of the subscription, by Stripe (web) or by your app store (mobile). If a payment fails, access to paid features may be suspended after several unsuccessful attempts and the subscription then cancelled; your account then goes back to Freemium.

We may change our prices. Any change is notified to you at least 30 days before it applies, and only takes effect at the next renewal; you may cancel before that date free of charge. On mobile, the information and consent procedure of Apple or Google applies.

4. Term and automatic renewal

The subscription is concluded for a term of one month and renews automatically, by tacit renewal, for successive one-month periods at the then-current price, unless cancelled before the end of the current period (at least 24 hours before for subscriptions purchased through an app store).

You may stop the renewal at any time and free of charge, as set out in Article 5. For subscriptions purchased on the web, cancellation is carried out online in a few clicks, in accordance with Article L215-1-1 of the French Consumer Code.

5. Cancellation

You may cancel at any time, with no commitment and no reason required:

Subscription purchased on the web: from your profile, via the Stripe management portal ("Manage my subscription").
Subscription purchased on iOS or Android: from the subscription settings of your App Store or Google Play account.

Deleting your Pronext account does not end your subscription: a subscription purchased through the App Store or Google Play continues to be billed by the app store until it is cancelled from the subscription settings of your Apple or Google account. Cancel the subscription as described above first, then delete your account if you wish.

Cancellation takes effect at the end of the current monthly period: you keep access to your plan until that date, then your account goes back to Freemium without losing your data. The period already started is not refunded, unless otherwise required by law or by your app store's refund policy.

We may cancel a subscription in the event of a breach of the Terms of Use or non-payment, with prior notice except in cases of urgency or legal obligation.

6. Changing plan

You may change plan at any time from your profile or your app store. Upgrading from Standard to Pro applies according to the rules of Stripe or your app store: immediately, with a pro-rata adjustment, or at the next renewal; you are never charged twice. Downgrading takes effect at the next renewal.

7. Right of withdrawal

In principle, you have fourteen days to withdraw from a contract concluded at a distance, without having to give any reason.

As the Service is digital content supplied without a tangible medium and accessible immediately, by subscribing you request its immediate performance and expressly waive your right of withdrawal for the part of the contract already performed, in accordance with Article L221-28, 13° of the French Consumer Code.

As long as access to the paid plan has not been opened, you may exercise your right of withdrawal by writing to us at contact@pronext-app.com or by using the model form below. We will then refund you no later than fourteen days after receiving your decision, using the same means of payment.

For purchases made through the App Store or Google Play, the refund policies of Apple and Google apply. You remain free to cancel at any time for the following period (Article 5).

8. No guarantee of winnings and conformity

The Service provides statistical analyses for information purposes. No plan guarantees any result, winnings or performance; the predictions constitute neither financial advice nor an inducement to bet. Pronext is not a gaming operator: no stake can be placed in the application and no money is committed beyond the subscription price. Gambling is prohibited for minors and involves risks (see Responsible gambling).

You benefit from the statutory guarantee of conformity applicable to digital content and digital services (Articles L224-25-12 et seq. of the French Consumer Code), as well as from the statutory guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). In the event of a lack of conformity, contact us at contact@pronext-app.com: we will bring the Service into conformity or, failing that, reduce the price or terminate the contract under the conditions provided by law.

Statutory guarantee of conformity

The consumer is entitled to the statutory guarantee of conformity where a lack of conformity appears throughout the term of the subscription, running from the supply of the digital content or digital service.

The statutory guarantee of conformity entails an obligation to provide all the updates necessary to maintain the conformity of the digital content or digital service throughout the term of the subscription.

The statutory guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without major inconvenience to them.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in return for giving up the digital content or digital service, where: 1° the trader refuses to bring the digital content or digital service into conformity; 2° bringing the digital content or digital service into conformity is unjustifiably delayed; 3° the digital content or digital service cannot be brought into conformity without cost to the consumer; 4° bringing the digital content or digital service into conformity causes major inconvenience to the consumer; 5° the lack of conformity persists despite the trader's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is not then required to first request that the digital content or digital service be brought into conformity.

Where the lack of conformity is minor, the consumer is entitled to terminate the contract only if the contract does not provide for the payment of a price.

Any period during which the digital content or digital service is unavailable in order to be brought back into conformity suspends the remaining guarantee period until the conforming digital content or digital service is supplied again.

The rights set out above result from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A trader who in bad faith obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to EUR 300,000, which may be increased to up to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. That guarantee gives the right to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.

9. Complaints, mediation and disputes

For any complaint, contact our support first: contact@pronext-app.com or the Contact page. We undertake to seek an amicable solution.

In accordance with Articles L612-1 et seq. of the French Consumer Code, you may use a consumer mediator free of charge within one year of your written complaint to our services. The contact details of the competent mediator are provided on request at contact@pronext-app.com.

These Terms of Sale are governed by French law, without depriving consumers residing in another European Union country of the mandatory protections of their place of residence. Failing an amicable settlement, the competent courts will have jurisdiction.

10. Changes to the Terms of Sale

We may amend the Terms of Sale to reflect changes to the Service or to regulations. The applicable version is the one in force on the date of subscription or renewal; any substantial change is notified to you at least 30 days before it takes effect.
